How Bail Works

When a person in arrested for a misdemeanor or felony in Texas they are brought to a county or municipal jail. At the jail the person will be photographed, fingerprinted and will be given a copy of the charges that the officer has filed against them. Depending on the type of charge, and numerous other factors, a bond amount will be set or the defendant will need to see a judge when they are available. The staff at the jail have no input as to the bail amount or any of the conditions, this is all done by a judge at the court. 

When a bond is set a person can choose to pay the full bond amount, in cash, to the county jail or they may call a professional bail bondsman. The benefit of using a bondsman is the bond fee’s are significantly lower than paying the full bond amount. Bail bondsman charge a percentage of the bond so if a bond is set at $10,000 a person would only need $1,000 (10%) to be released. 

The bail bond remains in effect as long as the case is open. When the case comes to a completion the judge will issue a disposition of not guilty, guilty, no contest, nolo contendere, or dismissed. When the disposition is issued the bail bond is no longer in place and there are no restrictions that involve the bonding company.
